Introduction

These Terms of Service ("Terms") govern your access to and use of ImageToPrompt, available at imagetoprompt.dev. ImageToPrompt is operated by Othmane Ferhan, based in Casablanca, Morocco.

By accessing or using ImageToPrompt, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the service.

Service Description

ImageToPrompt is a free, AI-powered web tool that analyzes uploaded images and generates optimized text prompts for use with AI image generation models including Midjourney, Stable Diffusion, Flux AI, DALL-E 3, Adobe Firefly, Leonardo AI, and Ideogram.

• The service is provided free of charge.
• We offer up to 10 free image analyses per day per user, enforced by IP-based rate limiting.
• The service is provided "as is" and "as available" without any express or implied warranties.
• We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

Acceptable Use

By using ImageToPrompt, you agree to the following:

You MAY:

• Use ImageToPrompt for personal, commercial, and creative purposes.
• Use generated prompts in any AI image generator of your choice.
• Share and publish images or prompts you create using ImageToPrompt.
• Use the service as often as permitted by the daily rate limit.

You MAY NOT:

• Upload images that are illegal under applicable law, including but not limited to images depicting child sexual abuse material (CSAM), non-consensual intimate imagery, or illegal activity.
• Upload images of minors in any inappropriate, sexual, or exploitative context.
• Attempt to reverse engineer, decompile, or extract the source code or underlying models of the service.
• Use automated bots, scrapers, or scripts to access the service at a rate that exceeds normal human use, or to circumvent rate limits.
• Attempt to attack, overload, disrupt, or otherwise compromise the security or availability of the service.
• Upload images for which you do not have the right to use (e.g., images that violate third-party copyright that you are not licensed to reproduce).
• Use the service in any way that violates applicable local, national, or international laws or regulations.

Intellectual Property

Generated Prompts

Text prompts generated by ImageToPrompt are provided for your free use. We do not claim copyright or any intellectual property rights over the prompts generated from your uploaded images. You are free to use, modify, share, and publish generated prompts without restriction from us.

Your Responsibility

You are solely responsible for ensuring that your use of generated prompts complies with the terms of service of the AI image generator you use them with (e.g., Midjourney's Terms of Service, Stability AI's terms, OpenAI's policies). ImageToPrompt is not responsible for how third-party platforms interpret or respond to prompts generated by our tool.

ImageToPrompt Brand

The ImageToPrompt name, logo, website design, and all original content on imagetoprompt.dev remain the intellectual property of Othmane Ferhan. You may not use our brand assets without prior written permission.

Disclaimer of Warranties

ImageToPrompt is provided "as is" and "as available" without warranty of any kind, whether express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose.
• Warranties that the service will be uninterrupted, error-free, or secure.
• Warranties regarding the accuracy, quality, or completeness of generated prompts.
• Warranties that generated prompts will produce any specific output in any AI image generator.

AI-generated prompts are approximate interpretations of your uploaded image based on AI analysis. Results may vary significantly across different AI models, versions, and settings. We do not guarantee that any prompt will produce a result similar to your original image.

Limitation of Liability

To the fullest extent permitted by applicable law, Othmane Ferhan and ImageToPrompt shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
• Any damages resulting from the accuracy, quality, or content of generated prompts.
• Any copyright claims, intellectual property disputes, or legal actions related to images you upload or prompts you generate.
• Any loss of data, revenue, or profits resulting from your use of or inability to use the service.
• Any content generated by AI image generators using prompts from our tool.

In any case, our maximum liability to you shall not exceed the amount you paid for the service, which is zero for free users.

Service Availability and Changes

• We aim to keep ImageToPrompt available but do not guarantee continuous uptime.
• We may modify, suspend, or discontinue the service (or any part of it) at any time without notice.
• Daily usage limits, supported models, and features may change at any time without notice.
• We may update these Terms at any time. Continued use of the service after changes are posted constitutes acceptance.

Termination

We reserve the right to block, restrict, or terminate access to ImageToPrompt for any user who violates these Terms, at our sole discretion and without prior notice. Rate limiting and IP blocks may be applied to users who attempt to abuse the service.

Third-Party Services

ImageToPrompt uses third-party services including Anthropic's Claude API, Vercel, and others. Your use of ImageToPrompt is also subject to the applicable terms of those services. We are not responsible for the practices or content of third-party services.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes arising out of or relating to these Terms or your use of ImageToPrompt shall be subject to the exclusive jurisdiction of the courts of Casablanca, Morocco.
